Shannon Spurgeon - City Clerk Not Bonded- Violates State Law & The Council Won't Do A Darn Thing (or Can't) because of Mayor Jenker

How is it that the POLICE CHIEF, can be married to the CITY CLERK?

As was posted on "Ellis County Observer", our City Water Clerk collects money and is not bonded. Yet, the council can't (because Mayor Jenker calls the shots) or won't fire her because of her inability to be bonded.

She has collected money since she was hired right at a year or so ago.

State Law requires that clerks be bonded. Ms. Shannon ain't bonded, and can't be bonded, but no one knows why........

From the Local Government Code, Chapter 24.

§ 24.052. CLERK AND TAX ASSESSOR-COLLECTOR; BOND; POWERS AND DUTIES. (a) The governing body of the municipality shall appoint a competent person as clerk of the municipality. The clerk is also the tax assessor-collector of the municipality. (b) Before beginning to perform the duties of the office, the clerk must execute a good and sufficient bond with a surety company authorized to do business in this state. The bond must be: (1) in an amount determined by the governing body to be sufficient to protect the funds of the municipality, but not less than twice the largest amount collected at any one time in the preceding fiscal or calendar year; (2) approved by the governing body; and (3) filed and recorded in the minutes of the governing body. (c) The clerk has the same powers and duties that are imposed by the general laws on the clerk, treasurer, and tax assessor-collector of a Type A or Type B general-law municipality.Acts 1987, 70th Leg., ch. 149, § 1, eff. Sept. 1, 1987.

Maybe an audit would be in order by the Attorney General, as public funds are involved.

Why can't Ms. Shannon be bonded. This bond was supposed to be filed BEFORE she started to work, not a year later. We have been in violation of the law for a year or so, but who cares, this is Bardwell, and Jenker calls the shots, makes the rules, and the law.

Are we sure our funds and water bill payments have all went to the city coffer, since our clerk can't be bonded, and hasn't been bonded not 1 day of her employment?

Maybe the attorney general or someone should come in and audit the city books! Maybe they should remove the council and mayor, and the clerk from office for violating STATE LAW, because STATE LAW supercedes JENKER'S LAW.

You said it, Anonymous. Maybe someone needs to come do an audit and find out where our money is, and find out if it is where it should be.
